between Two Casitas, Santa Fe Vacation Rentals LLC (referred to herein as TCSFVR) and a Guest

 

In order to secure a reservation with TCSFVR, Guests must accept and agree to the Terms and Conditions that follow:

 

  1. Guest agrees to pay all rent and fees requested by TCSFVR at least 30 days before their arrival. Failure to do so will result in denial of access to the home.
  2. Parking
    1. Most Two Casitas homes offer off-street parking for at least one vehicle with the exception of Dulce, which has free and safe street parking.
    2. Parking availability varies from rental to rental.
    3. Vehicles are to be parked in designated parking areas only.
    4. Any illegally parked cars are subject to towing or fines. Towing fees or fines are the sole responsibility of the vehicle owner.
    5. No trailers or recreational vehicles (RV’s) are permitted without prior permission from the homeowner and TCSFVR.
  3. Fireplaces
    1. The fireplace may be a wood-burning or a vented gas fireplace.
    2. Fireplaces are not available for use from May 15th – September 15th, and flues must remained closed during this time.
    3. Guest is responsible for all damages caused by smoke or fire.
    4. Do not throw any paper or other combustible materials in the fireplace.
    5. Do not leave children or pets unattended near the fireplace.
    6. Do not leave fire unattended.
    7. Screens must be on while a fire is burning.
    8. Guest must take caution when building your fire.
    9. If Guest chooses to clean the fireplace, all ash from fireplace must be placed in the provided covered container.
    10. Follow all posted instructions regarding the fireplaces in each home.
  4. Water/Plumbing
    1. All properties have either city water or well water. The mineral content in the tap water is high. Most people do not notice the difference, and the tap water is 100% safe to drink. The water may have an odor and taste that you are not accustomed to. If that is the case, we recommend that you purchase bottled water at a grocery store. TCSFVR will not reimburse any money or make any stay modifications due to the taste or smell of the water.
    2. DO NOT FLUSH anything (including feminine products) other than toilet paper and human waste.  Failure to follow this rule will result in the guest being charged for damages up to and including professional plumbing services and the cost of upcoming reservations should the property not be ready for future guests.
  5. Hot Tubs (If applicable)
    1. The Guest has permission to use the hot tub between the hours of 8am and 10pm. Guests must be considerate to your neighbors when it comes to noise.
    2. If TCSFVR receives complaint about excessive noise, or the hours of hot tub use are violated, your hot tub privileges will be revoked.
    3. Hot tubs have a maximum capacity of six people.
    4. Do not use the hot tub if you are pregnant or on any medication without consulting a doctor beforehand.
    5. Do not adjust the temperature of the hot tub. It is set between 101 – 104 degrees Fahrenheit. Changing of the temperature without the express permission of a TCSFVR employee or contractor will result in a $100 re-heating fee.
    6. Never disconnect the hot tub from power. TCSFVR will charge a $100 re-heating fee if this occurs, and the hot tub will need 24 hours to return to a normal temperature.
    7. Guest will never leave children unsupervised while using the hot tub.
    8. Guest must always replace the cover over the hot tub when not in use. Failure to do so will result in dirt/debris entering the hot tub along with a decline in water temperature.
    9. Guests are not to take glasses into or near the hot tub. TCSFVR provides plastic cups for this purpose.
    10. TCSFVR advises that no alcohol be consumed while using the hot tub.
    11. The water in each hot tub is fully inspected and maintained between all reservations. Should any of the following occur during a Guest’s stay, there will be a $100 fee charged to the card on file.
      1. Water becomes cloudy or opaque.
      1. Use of makeup or cosmetics while in the hot tub.
      2. Use of sun tan cream or oils.
      3. Dirty feet entering the hot tub (Guest must use sandals or other protective footwear when walking outside and approaching the hot tub).
      4. Spillage of drinks or other liquid in the water.
  1. Check-in/Check-out
    1. Check-in time is 3pm.
    2. Check-out time is 11am.
    3. Late check-outs are not allowed. Guest must vacate the premises by 11am on the agreed upon date in their reservation confirmation.
    4. Early check-ins are allowed on a case-by-case basis as long as a guest is not checking out the same day another guest is arriving, and the cleaning crew has had sufficient time to clean the home. Early check-ins must be arranged and approved by TCSFVR.
    5. Guest simply needs to lock the door upon departure and return the keys to the lock box if applicable.
       
  2. Housekeeping
    1. The rental will be professionally cleaned before the Guest arrives.
    2. There is no daily housekeeping service offered.
    3. Linens and bath towels are included with the rental.
    4. Towels and linens may not be removed from the rental.
    5. Requests for new linens and towels are permitted every seven days for rentals that do not have washers and dryers.
    6. Extra cleaning services can be arranged at Guest’s expense.
  3. Events, Parties and Gatherings
    1. Guest must inform TCSFVR of any events, parties, and gatherings to be hosted at the rental before the booking is made.
    2. No events, parties, or gatherings are allowed without prior approval from TCSFVR.
    3. Event fees may apply.
  4. TVs
    1. Written instructions for the television will be provided by TCSFVR
    2. All pay-per-view or other digital/cable media purchases are the Guest’s financial responsibility.
    3. Not all properties have Cable TV, and not all homes have smart TVs. Guest acknowledges that they have read and understood the type of entertainment system(s) that their rental has or does not have.
  5. Air-Conditioning
    1. Not all properties have air-conditioning. Guest acknowledges that they have read and understand the kind of air-conditioning that their rental has or does not have.
    2. Swamp/evaporative coolers are not available during the winter months. Air-conditioning is only guaranteed from June 1st – September 30th.
  6. Pet Policy
    1. Guest must disclose all dogs to TCSFVR. Failure to disclose dogs will result in a $1,000 fine charged to the credit card on file.
    2. TCSVR has the right to charge a pet fee. The amount will be specified in Guest’s quote or invoice provided by Two Casitas or the third-party listing site through which the Guest books (if applicable).
    3. Additional dogs must be approved by TCSFVR, and may incur additional fees.
    4. Dogs are not allowed in homes that are not pet-friendly.
    5. Only hypo-allergenic dogs are allowed in homes that have that specific restriction.
    6. Cats are not allowed in any homes except for Twilight.
    7. Animals other than dogs and cats must be approved by TCSFVR
    8. Guests will pay a $100 fine for not picking up their dog’s waste.
    9. Animals are not allowed on furniture at any time. Evidence of animals on furniture may result in additional cleaning fees.
    10. All pets are to be treated with a topical flea and tick repellent three days prior to arrival.
    11. If an animal damages the property or the landscaping, the Guest is fully responsible for any damage, as animal damage is not covered by the accidental damage waiver. Any damages must be reported to TCSFVR immediately.
    12. Guest must prevent pets from producing excessive noise at a level that disturbs neighbors. If, after we have contacted you that a complaint has been received, excessive noise persists, we reserve the right to cancel the reservation and ask the Guest to vacate the premises. Alternatively, the dog can be boarded at the guest’s expense. No refunds shall be given should this occur.
    13. TCSFVR and homeowner assume no responsibility for illness or injury that may incur to pets or humans while on the premises.
    14. It is the sole responsibility of the guest to comply with all New Mexico, County of Santa Fe and City of Santa Fe laws and ordinances as related to dogs.
    15. Guests are solely responsible for their pet(s) while on the property.
  7. An Accidental Damage Waiver/Insurance is included with every reservation.
    1. This waiver is a one-time, non-refundable fee that covers up to $1000 worth of repairs or replacements should any damage occur in the rental during a reservation.
    2. Guests must notify TCSFVR of the damages prior to their departure for the waiver to be honored.
    3. Guest must contact Two Casitas directly if you do not wish to participate in this plan. In such cases, guest must mail a $1,500 security deposit check to TCSFVR. This check should be made out to “Two Casitas” and sent to P.O Box 1829 Santa Fe, NM 87504. Upon Guest’s departure an inspection will be conducted, and the costs of any necessary repairs or excessive cleaning will be deducted from the security deposit. TCSFVR will return the remainder to the guest within 15 days from the guest’s departure.
    4. Exclusions and exceptions for Accidental Damage Protection Insurance coverage include the following (Guests are directly and financially responsible for damages that fall under these exceptions):
      1. Damage not reported to management prior to departure.
      1. Smoking in, or close to, the house. If smoke is detected there will be a fine of $1,000.
      2. Missing key(s) not returned to the lock box where applicable.
      3. Lost or stolen linens
      4. Theft
      5. Costs associated with returning items left in rentals prior to Guest’s departure.
      6. Pet damage in the home or around the grounds
      7. Gross negligence
      8. Misuse of appliances (anything other than their intended uses)
      9. Misuse of plumbing (Please note: much of Santa Fe has very old plumbing, so if anything other than toilet paper is put in the toilet, it can cause serious problems. Refer to section 12 of this contract for more information).
      10. Misuse of fireplaces; including smoke damages from improperly built fires or use of fireplace while flue is closed by TCSFVR.
  1. Cancellation Policy:
    1. If cancellation is submitted in writing sixty-one (61) days or more prior to arrival, a cancellation fee of 10% of the total rental, including all taxes and fees, plus a $75 service fee will be forfeited. The remaining balance of your deposit will be credited to your credit card or a check will be mailed to the address on file within 15 days.
    2. If a reservation is canceled in writing 60 days to 31 days prior to arrival, a cancelation fee of 50% of the total Rental including taxes and fees, plus a $75 service fee will be forfeited. The remaining balance of your deposit will be credited to your credit card or a check will be mailed to the address on file within 15 days.
    3. If a reservation is canceled in writing 30 days or less prior to arrival, the full rental amount including taxes and fees will be forfeited.
  2. Any Guest who stays longer than 28 days is considered a long-term guest.
    1.  Long-term guests are responsible for supplying their own toiletries, cleaning supplies, laundry supplies, and all other supplies needed for their stay. TCSFVR will reimburse guests for these supplies.
    2. Long-term guests must agree to and pay for a mid-stay cleaning for each month that they stay in rental.
  3. Guest shall allow TCSFVR and third-party contractors access to the property for the purposes of repair and inspection. TCSFVR shall exercise this right of access in a reasonable manner.
  4. Smoking is not allowed inside of the rentals. Smoking is allowed outside, but Guest must be fifteen feet away from any door or window. Guest must not smoke within 20 feet of any adjoining rental and its occupants if applicable. Violations of smoking rules will result in a $1,000 fee.
  5. Guests not included in the original party must not stay overnight in the property. Any non-renters in the homes are the sole responsibility of the Guest.
  6. All units are privately owned. The homeowners and TCSFVR are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities.
  7. The homeowners and TCSFVR are not responsible for any loss of personal belongings or valuables.
  8. Guest must keep the property and all furnishings in good order. The guest must not re-arrange the furniture.
  9. Illegal Activities: All authorized persons (those named on the lease agreement), and their guests shall abide by all municipal, county, state and federal laws. No weapons or illegal drugs are allowed at any property owned/managed by TCSFVR. Lessee agrees to allow TCSFVR full access to the property if an illegal activity is suspected. Lessee and his/her guests agree to immediately cooperate with law enforcement and emergency personnel. Any involvement in illegal activity by the lessee and his/her party or guests will result in immediate eviction and forfeiture of all money owed to TCSFVR.
  10. Lost Keys: In the event lessee, any member of his/her approved party, or their guest loses a key, TCSFVR reserves the right to charge a $25.00 key replacement charge. If the key loss is not discovered until after the lessee departs (prior to the next rental of that same property), you authorize TCSFVR to charge the credit card on file $25.00. In the event that the key loss leads to having to change door knob(s) and/or dead bolts, the lessee shall pay for the hardware, key copies and a $75.00 per hour labor fee. TCSFVR reserves the right to charge a lock out fee of up to $75.00 for after hour lockouts in addition to lost key charges.
  11. Internet – WIFI and Television Service: All properties offer Internet service. Most properties offer television service or a smart TV/Roku. Upon your arrival either internet or television is not functioning properly, you must notify TCSFVR immediately. TCSFVR will do everything possible to remedy the situation with in the first 24 hours of reporting the problem. Lessee/Guest fully agrees that the malfunction of either Internet (WIFI) or television (or both) does not constitute ground for a reduction or refund in/of rental fees. Nor does it constitute relocation to another property owned/managed by TCSFVR.
  12. Depiction of property on official Two Casitas Website: Two Casitas official website offers pictures and/or video of each property for you to view prior to making your reservation. Two Casitas portrays each property “as is” at the time the photos and/or video were taken. If the lessee, upon arrival at the contracted property determines that the pictures/video did not accurately portray the property, or otherwise become unsatisfied with the property for any reason TCSFVR will make every reasonable effort to resolve any specific problem(s). TCSFVR will not reduce and/or reimburse any portion of the rental amount. TCSFVR is not obligated to find and/or pay for alternate accommodations.
  13. Updates and Changes: TCSFVR reserves the right to update, revise, add, delete or make any other changes it deems necessary to the Two Casitas official website, advertisements, policy, rules, agreements, pictures, video, amenities, prices, fees, forms, documents, on-line copy, payment policy, check-in/out procedure (including times), and occupancy/rules (in general or property by property). Changes in any of the above mentioned shall not result in reduction or reimbursement of any/any/all the rental total.
  14. TCSFVR and/or Owner Discretion: TCSFVR reserves the right to exercise manager/owner discretion in any policy, rules, agreements, and/or addendums.
  15. Property Availability: In the unlikely event that a homeowner would break their contract with TCSFVR, and an individual property would no longer be available, TCSFVR will offer a comparable property(s). Should the lessee not accept he comparable property(s), TCSFVR is not obligated to any reduction and/or refund of the rental total. If a comparable property is not available, TCSFVR will inform the lessee with as much notice as possible so that the lessee can find alternate accommodations and only in this scenario will TCSFVR refund any amount collected from the lessee.
  16. Personal Property: TCSFVR, property owners and broker are not responsible lessee’s personal property (including the personal property of those staying at the rental and any guests of the lessee). TCSFVR, property owners and broker are not responsible for vehicles or any personal property left in vehicles. If our cleaning staff finds personal belongings after you depart, we can make arrangement to ship the belongings to you at your cost.
  17. Alarm Systems: For those homes equipped with an alarm system, any fines associated with false alarms caused by the Tenant will be the responsibility of the Guest and charged to credit card or checking account information on file.
  18. Emergency Services: Guest will always be responsible for all charges/fees arising out of a call by guest or anyone in his/her party to emergency services or 911. This includes Police, Ambulance and Fire services.
  19. After-Hours: For the purposes of this agreement, TCSFVR considers after hours to be between the hours of 8 PM and 8 AM mountain standard time. We are available for emergencies only after hours.
  20. Guest shall be liable for reasonable attorney’s fees and expenses incurred by the Owner or TCSFVR (and their agents and employees) should Guest breach this agreement or in the event Guest does not prevail in any claim brought by Guest against Owner and /or TCSFVR. The law of the State of New Mexico shall govern any and all disputes between the parties to this Agreement. Venue for any legal action between the parties shall be Santa Fe County, New Mexico.
